How does one make a fundamental part of an international treaty that happened over three hundred years ago and was ratified by yourself disappear in a flash? It’s easy if you’re an avid reader of a children’s books on sorcery, or perhaps a judge in England’s Supreme Court. The magic spell has five words – England has sovereignty over Scotland. It also goes without saying that it’s absolute balderdash, and merely a figment of someone’s imagination without an iota of evidence to support it. It might be wishful thinking on someone’s part, and others may even believe it, but it’s all stuff and nonsense. A de facto English Parliament and a de facto English government do not have the sovereignty they think or are told they have.

There’s only one thing that holds Scotland in perfidious Albion’s corrupt grasping embrace, and that’s the Parliamentary Union of 1707 which just happens to be an international treaty, and as such is beyond the competence of any English court. As the English historian Conrad Russell put it, “The Scots got their recognition as a separate sovereign state, both from the form of the union of 1707 as an international treaty, and from the survival of Scots law and the Scottish church. It is that claim that Scotland is a sovereign nation state which is reasserted whenever the English forget that 1707 was not a “perfect union” and has recently been repeated in the Claim of Right. Scotland in accepting the Union in 1707 remained a nation and as a result any sovereignty in the British parliament could not be national sovereignty. This has always been hard for the English to understand.”

So, the spell has been broken, along with a treaty, a practice England has built an invidious international reputation for, when a fundamental part of the treaty of union containing Scotland’s Claim of Right with its popular sovereignty, that was ratified by the English Parliament, was binned or ignored following the treaty, and replaced by English parliamentary sovereignty in Scotland. As Scotland’s Lord President Cooper said of it in 1953, it is a totally English concept that has no counterpart in Scottish constitutional law. Professor Mark Weller, former senior legal adviser to the UN would tend to agree with that when he said last year Scotland can have a legal referendum under UN law and it would be accepted and recognized internationally by international law. He went on to say that Johnson’s “once in a generation” is nonsense rhetoric with no legal standing.

It would now seem that Sara Salyer’s and her colleague’s wisdom and perseverance with Salvo is beginning to put the future of England’s unlawful manipulative treatment of Scottish constitutional law into a position where strangers to the truth often find themselves – between a rock and a hard place – with the UN being the rock, and the International Court of Justice at The Hague being the hard place. If you are a supporter of Scottish independence, whether affiliated to a political party or not, you are free to support the dissolution of what Sir Walter Scott called that bastard union, you must support Salvo at salvo.scot. There is a real alternative to a second referendum.

MY COMMENTS

This is indeed a powerful and accurate comment. Scotland is not subject to Westminster sovereignty. It never has been and at last, the false assumption is now being fiercely challenged and exposed. It is Salvo and Liberation that is exposing the fraud that has been imposed on Scots for generations. They are taking the argument onto an International stage. It is a political field where it is the English lie that is being exposed and clear fraud being revealed. Just how much wealth has been extracted from the territory of the nation of Scotland on a completely illegal basis?
