Angus faces challenge from Leah on behalf of Salvo/Liberation

Dear Angus Robertson,

I listened to your June 28th speech to the Scottish Parliament during the debate on a Scottish constitution. You seem to misunderstand what popular sovereignty means in Scotland. Popular sovereignty comes from the Scottish Crown, the People, the Community of the Realm and is profoundly different from English social contract sovereignty. The Scottish Crown is more permanent than Magna Carta and is the foundation of the UK constitutional settlement, based on 900 years of constitutional development. 

The Scottish Crown can never be transferred, either by a parliament, government or monarch. It was on pain of treason for a monarch to even think of doing so. This was spelt out in the Claim of Right 1689, a document passed by both the Parliaments of Scotland and England as a strict pre-condition of the Treaty of Union, and it was recently confirmed as current law in Scotland. The Scottish Crown wasn’t affected nor did it disappear at the 1707 Treaty of Union – despite the British Establishment telling us it did. 

The Treaty of Union didn’t have the authority to replace the Scottish Crown with the English one – it was a treaty between two sovereign nations. Scotland was effectively annexed by England, illegal under international law. Scotland’s assets have never belonged to the UK but to the People of Scotland. Our nation has been plundered by the larger ‘partner’ in this sham of a union. 

A constitution for a new Scottish state must be based on our existing autochthonous constitution, which puts the sovereignty of the People over any parliament or government. That means the Scottish People are put back in control of the nation’s land and resources.

A contemporary example of a nation where the People are sovereign in practice, is Switzerland. Scotland could learn much from their model of direct democracy and I urge you to look into this.
