This letter was published in the Herald on the 3rd January 2007. It followed after decades of the Scotland’s Oil campaign that highlighted how Scotland’s people were being robbed of their opportunity to share in the wealth off our shores.
Instead London took control and under both Labour and Tory Governments the contents of the McCrone Report were kept top secret.
Now we have learned this very weekend that Westminster had no rights to control these Scottish assets. That they were acting illegally, that neither the Treaty of Union or the Union of the Crowns gave them powers to act this way because those treaties were never Territorial Unions merely a political and economic Union. Control of assets in Scotland remain under the sovereignty of the people in Scotland. Westminster is guilty of fraud and deception because they knew they had no rights from the very beginning yet set up the “theft” in a manner to disguise this.
They have been caught and it is up to the rightful owners of those assets to determine what steps must be taken to rectify the wrong. Interfering with a nation’s assets infringing and ignoring the territorial sovereignty of the nation concerned is a serious offence in International Law. Nowhere in any Treaty does Scotland cede it’s territory. That is why there is still a Scottish border,why any Monarch in Scotland is referred to as King of Scots, or Queen of Scots, the land of Scotland was held by a monarch in trust for the people, the king or Parliament never had ownership. This is vital, you cannot surrender in Treaty any assets or property not owned by you. At the time of both those Treaties neither the King or Parliament owned the assets or territory of Scotland. You cannot surrender what you don’t or have ever owned. We joined a political and economic Union, not a territorial one.The territorial sovereignty of Scotland remains intact.
